Short answer

A parent abroad may seek cross-border contact without requesting the child’s return. Depending on the countries, dates and existing orders, the route may involve Article 21 of the 1980 Hague Convention, the 1996 Hague Child Protection Convention, recognition or enforcement of a foreign measure, negotiation, or a new proceeding before the competent Argentine court. A workable request must address both jurisdiction and the practical details of contact.

Return and contact are legally different remedies

A return application deals with alleged wrongful removal or retention. A contact case seeks effective communication, visits or time with the child. Article 21 of the 1980 Convention allows an application concerning rights of access to be presented to Central Authorities, but it does not simply convert every contact dispute into a return case. The desired remedy should be identified at the start.

The 1996 Hague Convention may now be relevant

The 1996 Child Protection Convention entered into force for Argentina on 1 January 2026. Between States for which it is in force, it addresses jurisdiction, recognition, enforcement and cooperation concerning parental responsibility and contact measures. Its temporal and territorial operation must be checked for both States and the relevant measure; its existence should not be assumed from the nationality of a parent or child. The current HCCH status table lists the United States as a signatory without ratification, so the Convention should not be presented as the route for a United States–Argentina case unless that status later changes.

Habitual residence usually anchors jurisdiction

Under the 1996 Convention, authorities in the child’s State of habitual residence generally have jurisdiction to take protection measures, subject to defined exceptions and urgent or provisional powers. Argentine Civil and Commercial Code Article 2639 also uses the child’s habitual residence for parental responsibility. A child’s presence in Argentina may support urgent protection, but does not automatically transfer full long-term jurisdiction.

A foreign contact order may need recognition or enforcement

A measure from another Contracting State may be recognised by operation of law under the 1996 Convention, while coercive implementation can require a declaration of enforceability or registration under local procedure. If that Convention or another treaty does not govern, Argentine procedural rules must be analysed. Recognition, enforcement and a request to modify future contact are not interchangeable.

A useful order must work in real life

The proposal should address time zones, school terms, video-call frequency, travel, passports, costs, handovers, supervision if genuinely needed, missed contact and emergency communication. A vague instruction to permit “reasonable contact” may be difficult to enforce across countries and can reproduce the same conflict.

The child’s rights and voice remain central

Age, maturity, routines, distance and the quality of the relationship must be considered. The Convention on the Rights of the Child protects contact with both parents when consistent with the child’s interests and requires the child’s views to receive due weight according to age and maturity. Listening to the child is not the same as making the child solely responsible for the outcome.

Evidence should demonstrate a pattern and a workable alternative

Complete call logs, message histories, proposed schedules, travel plans and responses are usually more useful than general allegations of obstruction. The evidence should show what contact was requested, whether it complied with an existing order, what occurred, and what concrete arrangement could function going forward.
